Transparent Milestone & Guarantee
Fees are strictly tied to verified milestone outcomes and certified root server deletion.
1. Acceptance of Terms & Service Scope
These Terms of Service ('Terms', 'Agreement') govern the engagement of Online News Removal ('Practice', 'we', 'our'), an executive legal-editorial communications practice headquartered in Delhi, India, by any individual, corporate client, or designated legal counsel ('Client', 'you').
By submitting a case audit, executing an engagement brief, or authorizing case triage, you confirm your acceptance of these Terms in their entirety. If you are acting on behalf of an entity, you warrant that you possess the legal authority to bind that entity.
2. Transparent Milestone & Upto 100% Guarantee Success Models
Our practice operates under Transparent milestone & Upto 100% Guarantee Success models: Professional fees are tied directly to agreed milestones and verified performance outcomes.
• Clear Milestone Deliverables: Deliverables are clearly structured from initial forensic investigation to certified root deletion and search de-indexing.
• Milestone Verification: Fees are released solely upon verified delivery of agreed milestones such as HTTP 404/410 Gone server headers, confirmed retraction, or search de-indexing.
• Unsuccessful Cases: If a publisher categorically refuses retraction and agreed outcomes cannot be achieved, funds for unfulfilled deliverables are released back to the Client under our guarantee models.
3. Client Representations & Lawful Grounds
To ensure compliance with global press freedom laws and journalistic ethics, Client represents and warrants:
• Factual Accuracy: All evidence, court decrees, expungements, dismissals, and corporate clarifications submitted to our triage desk are authentic, un-altered, and legally valid.
• Lawful Standing: Client possesses a bona fide legal, privacy, or ethical interest in the requested remediation (e.g. defamation, unproven allegations, dismissed charges, spent convictions, or severe privacy intrusion).
• Frivolous Claims: We reserve the right to decline or terminate representation if a submission involves active fraudulent impersonation, ongoing violent criminality, or deceitful evidence.
4. Turnaround Timeframes & Operational T&C
All stated operational timeframes (including 48-hour Rapid Review, emergency 72-hour triage, or 3–14 day resolution windows) represent historical benchmark averages for initial forensic intake, legal memorandum preparation, and editorial petition service.
• Editorial Cycle Latency: Actual completion schedules depend on publisher ombudsman review frequency, legal compliance department queues, newsroom publication cycles, and server jurisdiction.
• Search Index Latency: After publisher deletion, search engine cache purging (Google, Bing, Yahoo) is subject to algorithmic crawl frequency and Google Search Console processing times.
• No Absolute Time Guarantee: While our forensic team executes expedited protocols, external third-party entities cannot be controlled with exact minute-by-minute guarantees.
5. Mutual Non-Disclosure & Anti-Streisand Discretion
Both parties mutually commit to strict confidentiality regarding the subject matter of the engagement:
• Neither party shall disclose the existence of removal negotiations, settlement correspondence, or compensation details to any unauthorized third party or public forum.
• All communications directed to publishers are designated 'Confidential Crisis Remediation' to prevent unwanted media attention or counter-publicity (the Streisand effect).
6. Lifetime Warranty & Re-Removal Guarantee
All permanent removals executed by our practice are backed by an unconditional Lifetime Re-Removal Warranty:
• In the rare event that a deleted article is re-published, restored during a CMS migration, or republished on an un-cleared syndicate mirror, our team will re-engage at zero additional fee.
• Automated surveillance and periodic monitoring ensure ongoing brand integrity following case closure.
7. Limitation of Liability & Third-Party Independence
Our practice operates as an independent crisis communications and legal liaison entity. We do not own, control, or operate third-party news websites, wire syndicates, or search engines.
In no event shall Online News Removal, its operational directors, or affiliates be liable for indirect, incidental, punitive, or consequential damages resulting from third-party editorial publication decisions beyond the scope of lawful mediation.
8. Governing Law & Dispute Resolution
This Agreement shall be construed and governed in accordance with the laws of Delhi, India, without regard to conflict of law principles. Any dispute arising under this Agreement that cannot be resolved through amicable mediation shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
